NOTICE TO ONLINE ENTRANTS
In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the "Authorized Union Sportsmen's Alliance (USA) Member" and through the membership information submitted at time of entry. Authorized Union Sportsmen's Alliance Member means the natural person who is assigned to a unique USA member number. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Sponsor is not responsible for: (i) lost, late, misdirected, damaged, illegible or postage due mail/entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant's or any other person's computer related to or resulting from participating in the sweepstakes. By participating in the Sweepstakes, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these official rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to: (i) permanently disqualify from any sweepstakes it sponsors any person it believes has intentionally violated these official rules; and (ii) withdraw the online method of entry if it becomes technically corrupted, (including if a computer virus or system malfunction inalterably impairs its ability to conduct the sweepstakes), and to select winners from among all eligible entries received prior to withdrawal.

The Beretta-Union Sportsmen's Alliance Texas Motor Speedway Sweepstakes ("Sweepstakes") will begin at (Insert time) AM Eastern Daylight Time (EDT) on (Insert day), 2008 ("Sweepstakes Start Date"), and end at 11:59 PM EDT on October 15, 2008 ("Sweepstakes Period"). Eligibility: Sweepstakes is open to all Unions Sportsmen's Alliance members with a valid membership id number which was activated between the dates of July 1, 2007 and October 15, 2008 and to any individual who enters via a 3''x 5'' card to Sponsors address (see below). All entrants must be 18 years of age or older as of ''Sweepstakes Start Date.'' Winner must be an active or retired member of an AFL-CIO affiliated union or a direct family member of an active or retired AFL-CIO affiliated union member. Employees, officers and directors of the Sponsor, their affiliates, subsidiaries, agents, and vendors (collectively including Sponsor, ''Sweepstakes Entities'') their immediate family members (parents, children, siblings, spouses) and persons living in the same household (whether related or not), are not eligible to participate in the Sweepstakes. All federal, state and local laws and regulations apply. Void where prohibited.
How To Enter: 1.) Enter by simply completing the online Sweepstakes registration form at www.unionsportsmen.org . All entries must be received by 11:59 PM EDT on October 15, 2008. 2.) Enter by hand printing on a 3''x 5'' card, your name, date of birth, USA member number (if applicable), address (including zip code), day & evening phone numbers, union and local # (if applicable) and e-mail address. Mail the card to: ''Beretta-Union Sportsmen's Alliance Texas Motor Speedway Sweepstakes'' at 3340 Perimeter Hill Dr., Nashville, TN 37211. All entries must be postmarked by October 11, 2008, and received by October 17, 2008, and become the property of the Sponsor. One entry per person/e-mail address regardless of the method of entry. The use of automated entry devices is prohibited and all such entries are void. By participating, you consent for Sponsor to obtain, use, and transfer your name, address and other information for the sole purpose of administering this Sweepstakes. Sweepstakes Entities are not responsible for: lost, late, incomplete, illegible, incorrect, delayed, garbled, undelivered, misdirected, stolen, postage-due registrations, entries or mail. Sponsor reserves the right to disqualify any person or e-mail address that submits more than maximum allowed entries. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.
Internet Limitations of Liability: If for any reason this sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the sweepstakes in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of this termination date. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this sweepstakes or downloading any materials in this sweepstakes. Prizes: One (1) Grand Prize winner will receive a 3 nights/3 days Texas Motor Speedway (TMS) trip for two (2) people. The trip includes round-trip coach airfare, lodging, race tickets, pit passes, VIP suite passes, TMS merchandise package and one (1) Beretta 3901 American Citizen Synthetic shotgun. The Approximate Retail Value of the Grand Prize is $6,000. The winner will receive coach air transportation for two (2) people from the major commercial airport nearest the winner's home. Stopovers are not permitted on flight voucher issued and, if a stopover occurs, the prize will terminate at the stopover point and full fare will be charged for the remaining segments of the flight. The Sponsor (or Sponsor designee), in its sole discretion, will determine transportation and lodging accommodations. The travel, event tickets, accommodations and shotgun can not exceed the maximum allowable prize amount of $6,000. While prize suppliers will make every effort to confirm reservations as requested, operational and/or market conditions may prevent them from doing so on the requested dates. Travel, event tickets and accommodations are subject to capacity controls, availability, blackout dates and other restrictions, all of which are subject to change at Sponsor’s sole discretion. Winner and his/her guest will be solely responsible for all other expenses not specifically set forth herein including but not limited to meals, taxes, transportation, gratuities, souvenirs, telephone, in-room services and any other incidentals. Travel and accommodations subject to availability; and certain restrictions may apply. Winner and travel companion must execute liability/publicity releases prior to issuance of travel documents. If travel companion is a minor, parent or legal guardian must sign and return release and accompany minor on trip. The Prize awarded consisting of products/services for two people require that you and your companion redeem the prize together. The Grand Prize will be deemed awarded upon the winner's receipt of event tickets (or voucher) and travel/lodging confirmation. Sponsor will not replace any lost, mutilated, or stolen travel vouchers, certificates or event tickets and passes. By accepting the prize, prize winner agrees to release Sweepstakes Entities from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the promotion or for damages of any kind caused by any prize or resulting from acceptance, possession, or use/misuse of prize awarded, or while preparing for, participating in, and/or traveling to and from any prize-related activity. All local, state and federal taxes are the sole responsibility of winner. If the event portion of prize is cancelled or rescheduled for any reason, Sponsor will not be responsible for awarding that portion of the prize, but the remainder of the prize package will be awarded. The Prize package is not exchangeable, transferable, or redeemable for cash. There are no substitutions unless specified by the Sponsor. The Sponsor reserves the right at its sole discretion to substitute any prize package with another prize of equal or greater value in the event that the prize (or any component thereof) is not available. The trip must be completed by November 5, 2008 or prize will be forfeited.
Drawing and Notification: The potential Grand Prize Winner will be selected, from among all eligible entries members, in a random drawing conducted on or about October 17, 2008 by the TRCP whose decisions are final in all matters relating to this Sweepstakes. Odds of winning will depend on the total number of eligible entries received. Potential winners will be notified by phone and mail. Upon initial notification and verification of potential Grand Prize winner, confirmation will be sent to winner in writing via USPS mail, or other home delivery service of Sponsor’s choice.
Prize Conditions: Winners are solely responsible for all applicable federal, state, and local taxes associated with the receipt of any prize. The Grand Prize winner will be required to sign an Affidavit of Eligibility and Liability/Publicity Release, and return it within 5 days of written notification. Travel companion must also execute and return a travel release. If travel companion is a minor, parent or legal guardian must sign and return release and accompany minor on trip. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes. All taxes, if applicable, are the sole responsibility of the winner. The winner's entry and acceptance of the prize offered constitutes permission (except where prohibited) for the Sponsor to use said winner's name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.
Terms and Conditions: This sweepstakes is subject to all applicable federal, state, and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and waive any right to claim ambiguity in the sweepstakes or these Official Rules. Winners and entrants also agree to release, discharge, indemnify and hold harmless the Sponsor, sponsors and vendors associated with the sweepstakes, and the respective officers and employees of these entries, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in any part, directly or indirectly, from acceptance, possession, use or misuse of any prize offered, or participation in this sweepstakes.
