Member Story Sweepstakes Giveaway Official Rules and Copyright Waiver
NOTICE TO ONLINE ENTRANTS
In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the "Authorized Union Sportsmen’s Alliance (USA) Member" and through the membership information submitted at time of entry. Authorized Union Sportsmen’s Alliance Member means the natural person who is assigned to a unique USA member number. Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a script, macro or use of automated devices are void. The Sponsor is not responsible for: (i) lost, late, misdirected, damaged, illegible or postage due mail/entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant's or any other person's computer related to or resulting from participating in the sweepstakes. By participating in the Sweepstakes, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor, which are final and binding in all matters relating to the Sweepstakes. Failure to comply with these official rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to: (i) permanently disqualify from any sweepstakes it sponsors any person it believes has intentionally violated these official rules; and (ii) withdraw the online method of entry if it becomes technically corrupted, (including if a computer virus or system malfunction inalterably impairs its ability to conduct the sweepstakes), and to select winners from among all eligible entries received prior to withdrawal.
Official Rules
Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. The Union Sportsmen’s Alliance Member Story Sweepstakes Giveaway ("Sweepstakes") will begin at 12:00 PM Eastern Daylight Time (EDT) on April 17, 2008 ("Sweepstakes Start Date"), and end at 11:59 PM EDT on May 31, 2008 ("Sweepstakes Period").  Sweepstakes is sponsored by the THEODORE ROOSEVELT CONSERVATION PARTNERSHIP, INC., a non-profit corporation established in the District of Columbia (“Sponsor”) located at 555 Eleventh Street NW, 6th Floor, Washington, DC 20004.  Prizing is provided by Beretta USA, a corporation located at 17601 Beretta Drive, Accokeek, MD  20607.  

Eligibility: Sweepstakes is open to all Unions Sportsmen’s Alliance members with a valid membership id number which was activated between the dates of July 1, 2007 and May 31, 2008 and who are legal residents of the United States and the District of Columbia (EXCLUDING WITHOUT LIMITATION, THOSE RESIDENTS IF LOCATED IN AN OVERSEAS MILITARY INSTALLATION, PUERTO RICO, OTHER U.S. TERRITORIES OR FOREIGN TERRITORIES) and Canada.  Offer void where prohibited by law, or otherwise restricted.  All entrants must be 18 years of age or older as of “Sweepstakes Start Date.”  Winner must be an active or retired member of an AFL-CIO affiliated union or a direct family member of an active or retired AFL-CIO affiliated union member.  Employees, officers and directors of the Sponsor, their affiliates, subsidiaries, agents, and vendors (collectively including Sponsor, “Sweepstakes Entities”) their immediate family members (parents, children, siblings, spouses) and persons living in the same household (whether related or not), are not eligible to participate in the Sweepstakes. All federal, state and local laws and regulations apply.

How to Enter: Enter by submitting a hunting or fishing story of at least 300 words, written by you, via the USA website or USA e-newsletter.  All entries must be received by 11:59 PM EDT on May 31, 2008.  All entries become the property of the Sponsor.  By participating, you consent for Sponsor to obtain, use, and transfer your name, address and other information for the sole purpose of administering this Sweepstakes. Sweepstakes Entities are not responsible for: lost, late, incomplete, illegible, incorrect, delayed, garbled, undelivered, misdirected, stolen, postage-due registrations, entries or mail. All entries become the exclusive property of Sponsor and will not be acknowledged or returned.

Internet Limitations of Liability: If for any reason this sweepstakes is not capable of running as planned due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this sweepstakes, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the sweepstakes in whole or in part, at any time, without notice and award the prizes using all non-suspect eligible entries received as of this termination date. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer relating to or resulting from participation in this sweepstakes or downloading any materials in this sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Prizes: One (1) Grand Prize winner will receive a BerettaAL391 Urika2 Gold 12 gaugeshotgun.  Approximate Retail Value of the Grand Prize is $1,450.00*.  Full details regarding the firearm can be seen at the Beretta website or by linking to the following website: http://www.berettausa.com/product/product_field_guns_main.htm.  Winner is solely responsible for any and all expenses relative to participation in Sweepstakes (including acceptance of prize) not specified herein and is not entitled to the difference between the approximate retail value and the actual value of the grand prize and they must themselves be able to pick up the grand prize at a local firearm distributor around 6/15/2008. All local, state and federal taxes incurred are the sole responsibility of the winner.  Sales tax may vary from state to state and is the responsibility of the winner, not the TRCP, the Union Sportsmen’s Alliance, Beretta USA or the distributor to determine this value.  The winner must be able to secure a firearm permit in order to accept the Beretta BerettaAL391 Urika2 Gold 12 gaugeshotgun.  If, for any reason, the winner cannot secure a firearm permit, he/she, at the discretion of the Union Sportsmen’s Alliance, may receive gift certificates of equal or lesser value than the BerettaAL391 Urika2 Gold.  The Sponsor reserves the right, at its sole discretion, to substitute any prize package with another prize of equal or greater value in the event that the prize (or any component thereof) is not available. The prize is awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).  By accepting the prize, prize winner agrees to release Sweepstakes Entities from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the promotion or for damages of any kind caused by any prize or resulting from acceptance, possession, or use/misuse of prize awarded, or while preparing for, participating in, and/or traveling to and from any prize-related activity.

Drawing and Notification: The potential Grand Prize Winner will be selected, from among all eligible entries received, in a random drawing conducted on or about June 6, 2008 by the TRCP whose decisions are final in all matters relating to this Sweepstakes. Odds of winning will depend on the total number of eligible entries received. Potential winners will be notified by phone and mail. Upon initial notification and verification of potential Grand Prize winner, confirmation will be sent to winner in writing via USPS mail, or other home delivery service of Sponsor’s choice.

Prize Conditions: Winners are solely responsible for all applicable federal, state, and local taxes associated with the receipt of any prize. The Grand Prize winner will be required to sign an Affidavit of Eligibility and Liability/Publicity Release, and return it within 5 days of written notification. Failure to comply with these Official Rules may result in disqualification from the Sweepstakes.  The winner’s entry and acceptance of the prize offered constitutes permission (except where prohibited) for the Sponsor to use said winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state), in all forms of media, in perpetuity, without notice or further compensation.

Terms & Conditions: This sweepstakes is subject to all applicable federal, state, and local laws. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor and waive any right to claim ambiguity in the sweepstakes or these Official Rules. Winners and entrants also agree to release, discharge, indemnify and hold harmless the Administrator/Sponsor, Beretta U.S.A. and their agencies and their respective parents, affiliates, subsidiaries and successor companies, and their respective officers, directors, employees, representatives, and agents (hereinafter the "Released Parties") from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in any part, directly or indirectly, from acceptance, possession, use or misuse of any prize offered, or participation in this sweepstakes. Any person attempting to defraud or in any way tamper with the sweepstakes mechanics and/or implementation will be prosecuted to the full extent of the law. This sweepstakes is void where prohibited.

USA MEMBER COPYRIGHT WAIVER
I acknowledge and agree that I have the exclusive right and authority to grant this license to use the material I submit to TRCP/USA. I hereby grant to TRCP/USA the royalty-free, worldwide, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, distribute and display any photographs, images, stories or other materials submitted by me and to incorporate the photographs, images, stories or other materials now or at any time in the future, including without limitation, in labels, magazine advertisements, websites, television productions and other media or technology. In addition, I hereby irrevocably and perpetually waive all copyrights and moral rights which cannot be assigned or licensed to TRCP/USA and covenant not to bring or participate in any action against TRCP/USA or its representatives or affiliates or any of their successors for infringement or misappropriation of such rights. I agree that my sole consideration for this license and waiver shall be the chance to obtain publicity for my photographs, images, stories and other material submitted and that there are to be no fees, commissions or royalties paid to me for use of the photographs, images, stories or other materials I submit to TRCP/USA.  I also understand and agree that TRCP/USA is not responsible for lost or damaged photos, images, stories or other materials submitted and understand that photos, images, stories and other materials submitted will not be returned.
